PRIVACY POLICY

INTRODUCTION

1.1 Welcome to the MummyNanny platform (“the Site”) run by Brandish Creative Enterprise (hereinafter referred to as "MummyNanny", "we", "us", or "our"). We take our responsibilities under applicable privacy laws and regulations ("Privacy Laws") seriously and are committed to respecting the privacy rights and concerns of all “Users” of the Site (we refer to the Site and the services we provide as described in the Site collectively as the "Services"). We recognize the importance of the Personal Information (i.e., information that can be used to directly identify you) that you have entrusted to us and believe that it is our responsibility to properly manage, protect and process such information. This “Privacy Policy” is designed to assist you in understanding how we collect, use, disclose and/or process the Personal Information you have provided to us and/or we possess about you, whether now or in the future, as well as to assist you in making an informed decision before providing us with any of your Personal Information.
1.2 You agree and understand that in order to utilize certain portions of the Services, you may be required to complete a “Sign Up” process for creating an “Account” with MummyNanny by providing your names, a valid email and a password. This information will be used so that you can securely access and maintain your Account.
1.3 We reserve the right, at our discretion, to modify any part of this Privacy Policy at any time, in which case we will update the "Last Updated" date to reflect the date of the changes. Any changes to this Privacy Policy will be effective immediately. We suggest that you review this Privacy Policy regularly to ensure that you are aware of any changes. You agree that your continued use of the Site or our services will constitute acceptance of any changes to this Privacy Policy. If you do not agree to the changes, you may delete your Account and you should not use the Site or any services offered through the Site after the effective date of the changes.
1.4 By using the Services, creating a MummyNanny Account, visiting the Site, or accessing the Services, you acknowledge and agree that you accept the practices, requirements, and/or policies outlined in this Privacy Policy, and you hereby consent to us collecting, using, disclosing and/or processing your Personal Information as described herein. If you do not consent to the processing of your Personal Information as described in this privacy policy, please do not use the Services or access the Site.
1.5 This Privacy Policy is incorporated into and is subject to the Site’s “Terms and Conditions”. Your use of the Services and any Personal Information you provide through the Services are subject at all times to this Privacy Policy and the Terms and Conditions.

HOW WE COLLECT INFORMATION

2.1 We will/may collect personal data about you: (i) when you use the Services or the Site, or create an Account with us; (ii) when you submit any form, including, but not limited to, application forms or other forms relating to any of our services, whether online or through a physical form; (iii) when you enter into any agreement or provide other documentation or information in respect of your interactions with us, or when you use our services; (iv) when you interact with us, such as via telephone calls (which may be recorded), letters, fax, face-to-face meetings, social media platforms and emails; (v) when you use our electronic services, or interact with us via our application or use services on the Site; (vi) when you carry out transactions through the Services; (vii) when you provide us with feedback or complaints; or (viii) when you submit your Personal Information to us for any reason. This does not purport to be exhaustive and sets out some common instances of when Personal Information about you may be collected.
2.2 When you visit, use or interact with the Site, we may collect certain information by automated or passive means using a variety of technologies, which technologies may be downloaded to your device and may set or modify settings on your device. The information we collect may include, without limitation, your Internet Protocol (IP) address, computer/mobile device operating system and browser type, type of mobile device, the characteristics of the mobile device, the unique device identifier (UDID) or mobile equipment identifier (MEID) for your mobile device, the address of a referring web site (if any), and the pages you visit on our website and mobile applications and the times of visit. We may collect, use disclose and/or process this information only for the purposes defined in this Privacy Policy.

INFORMATION WE COLLECT

3.1 We collect Personal Information from Users only if they voluntarily submit such information to us. Users can always refuse to supply Personal Information, except that it may prevent them from utilizing certain portions of the Services. The Personal Information that we may collect includes but is not limited to: names; email address; telephone number; any other information about the User collected during the Sign Up process and when the User uses the Services or the Site, as well as information related to how the User uses the Services or the Site; and aggregate data on content the User engages with. If you do not want us to collect the aforementioned information, you may opt out at any time by deleting your MummyNanny Account.
3.2 We may also collect information that does not identify you when you visit the Site. This includes but is not limited to: (i) your country of residence in order to dislay correct information when finding Nannies; (ii) non-personal parts of your address such as country, state, city and/or zip code, which you may enter in application or billing forms; and (iii) data we use for inferring traffic on the Site, such as your IP address, browser type, the time of your visit, and any referring website.
3.3 As a Mummy, you are required to complete your Profile by uploading a Profile Photo, adding your Contact Information and updating your Expected Delivery Date. Note that: (i) only Nannies who receive a Job Request from you will be able to view your Contact Information; and (ii) your Expected Delivery Date is used to provide you with Nannies that will be available during your confinement period and will be accessible by you alone.
3.4 As a Nanny, you are required to complete your Profile by uploading a Profile Photo, as well as adding your Contact Information, Date of Birth, Estimated Daily Salary and your Bank Account Information. Note that any User who visits your Nanny Profile will be able to view your Contact Information, Age and Estimated Daily Salary. On the other hand, your Bank Account Information will not be made public and will only be available to MummyNanny for making payouts to your bank account in order for you to receive funds.

HOW WE USE YOUR PERSONAL INFORMATION

4.1 We may collect, use, disclose and/or process your Personal Information for one or more of the following purposes:
(i) to manage, operate, provide and/or administer your use of and/or access to the Services and the Site, as well as your relationship and Account with us;
(ii) to manage, operate, administer and provide you with as well as to facilitate the provision of the Services, including, without limitation, remembering your preferences;
(iii) to consider and/or process career applications or requests submitted through the Site;
(iv) for identification, verification and recovery;
(v) to respond to, process, deal with or complete a transaction and/or to fulfil your requests for certain products and services and notify you of service issues and unusual account actions;
(vi) to enforce our Terms and Conditions or any applicable end user license agreements;
(vii) to protect personal safety and the rights, property or safety of others;
(viii) to maintain and administer any software updates and/or other updates and support that may be required from time to time to ensure the smooth running of the Services;
(ix) to deal with or facilitate customer service, carry out your instructions, deal with or respond to any enquiries given by (or purported to be given by) you or on your behalf;
(x) to contact you or communicate with you via voice call, text message and/or fax message, email and/or postal mail or otherwise for the purposes of administering and/or managing your relationship with us or your use of our Services, such as but not limited to communicating administrative information to you relating to our Services (you acknowledge and agree that such communication by us could be by way of the mailing of correspondence, documents or notices to you, which could involve disclosure of certain personal data about you to bring about delivery of the same as well as on the external cover of envelopes/mail packages);
(xi) to allow other Users to interact or connect with you on the Site, including to inform you when another User has sent you a private message or visited your Profile;
(xii) to conduct research, analysis and development activities (including, but not limited to, data analytics, surveys, product and service development and/or profiling), to analyse how you use the Services, to improve the Services and/or to enhance your experience on the Site;
(xiii) to allow for audits and surveys to, among other things, validate the size and composition of our target audience, and understand their experience with the Services;
(xiv) where you give us your prior consent, for notification and in this regard, to send newsletters about the Service, announcements and events by email;
(xv) to respond to legal processes or to comply with or as required by any applicable law, governmental or regulatory requirements of any relevant jurisdiction, including, without limitation, meeting the requirements to make disclosure under the requirements of any law binding on us or on our related corporations or affiliates;
(xvi) to produce statistics and research for internal and statutory reporting and/or record-keeping requirements;
(xvii) to carry out due diligence or other screening activities (including, without limitation, background checks) in accordance with legal or regulatory obligations or our risk management procedures that may be required by law or that may have been put in place by us;
(xviii) to audit our Services or business;
(xix) to prevent or investigate any actual or suspected violations of the Terms and Conditions, fraud, unlawful activity, omission or misconduct, whether relating to your use of the Services or any other matter arising from your relationship with us;
(xx) to store, host, back up (whether for disaster recovery or otherwise) of your Personal Information, whether within or outside of your jurisdiction;
(xxi) to deal with and/or facilitate a business asset transaction or a potential Business Asset Transaction (which refers to the purchase, sale, lease, merger, amalgamation or any other acquisition, disposal or financing of an organisation or a portion of an organisation or of any of the business or assets of an organisation), where such transaction involves MummyNanny as a participant or involves only a related corporation or affiliate of MummyNanny as a participant or involves MummyNanny and/or any one or more of our related corporations or affiliates as participant(s), and there may be other third party organisations who are participants in such transaction; and/or
(xxii) any other purposes which we notify you of at the time of obtaining your consent.
4.2 You acknowledge, consent and agree that we may access, preserve and disclose your Account information and content if required to do so by law or pursuant to an order of a court or by any governmental or regulatory authority having jurisdiction over MummyNanny or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (i) comply with legal process; (ii) comply with a request from any governmental or regulatory authority having jurisdiction over MummyNanny; (iii) enforce the Terms and Conditions or this Privacy Policy; (iv) respond to any threatened or actual claims asserted against us or other claim that any content violates the rights of third parties; (v) respond to your requests for customer service; or (vi) protect the rights, property or personal safety of MummyNanny, the Users and/or the public.
4.3 As the purposes for which we will/may collect, use, disclose or process your Personal Information depend on the circumstances at hand, such purpose may not appear above. However, we will notify you of such other purpose at the time of obtaining your consent, unless processing of the applicable information without your consent is permitted by the Privacy Laws.

SHARING YOUR PERSONAL INFORMATION

5.1 Our Services enable you to post reviews and recommendations without our involvement. When posting such information, please do not include any Personal Information unless you wish for it to be publicly disclosed. We are not responsible for the use or disclosure of any Personal Information that you disclose in connection with your Profile or Portfolio.
5.2 In conducting our business, we will/may need to disclose your Personal Information to our third party service providers, agents and/or our affiliates or related corporations, and/or other third parties, for one or more of the purposes stated in Section 4. Such third party service providers, agents and/or affiliates or related corporations and/or other third parties would be processing your Personal Information either on our behalf or otherwise, for one or more of the purposes stated in Section 4. Such third parties include, without limitation:
(i) other users of our Platform for one or more of the purposes stated in Section 4;
(ii) our subsidiaries, affiliates and related corporations owned or controlled by, or under common ownership or control with, MummyNanny;
(iii) contractors, agents, service providers and other third parties we use to support our Services, which includes but not limited to those which provide administrative or provide other services to us such as sending emails, push notifications, or SMS messages on our behalf, assessing potential fraud, website hosting, maintenance, security services, payment processing, assisting us in delivering or improving the Services and creating new features, conducting data analysis and creating reports, and conducting surveys or sweepstakes on our behalf;
(iv) a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which Personal Information we hold about our Users is among the assets transferred;
(v) a counterparty in a business asset transaction that we or any of our affiliates or related corporations are involved in;
5.3 We also reserve the right to disclose your Personal Information in order to: (i) protect or defend our legal rights or property or the rights/property of our other users, business partners, employees, agents and contractors (including enforcement of our agreements); (ii) investigate and defend ourselves against third-party claims or allegations; (iii) pursue available remedies or limit the damages that we may sustain; (iv) protect the safety and security of our employees, the Users, or members of the public; (v) protect the security or integrity of the Services; (vi) protect MummyNanny from fraudulent, abusive, or unlawful uses or for other risk management purposes; or (vii) comply with the law or respond to law enforcement requests, subpoenas, legal process or inquiries.
5.4 For the avoidance of doubt, in the event that Privacy Laws or other applicable laws permit an organisation such as us to collect, use or disclose your Personal Information without your consent, such permission granted by the laws shall continue to apply.

ACCESSING AND CORRECTING PERSONAL INFORMATION

6.1 If you wish to access and/or correct your Personal Information currently in our possession or control, you may personally do so through your Account settings. We will retain your Personal Information for as long as your Account is Active or as needed to provide you the Services. If you wish to cancel your membership or request that we no longer use your Personal Information to provide you the Services, you can terminate your Account through your Account settings. In the event of such termination, we will cancel or remove your Personal Information but may retain and use copies of your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

OPT-OUT POLICY

7.1 You can discontinue receiving emails about announcements, events or any other newsletter emails from us at any time by unsubscribing from the respective mailing list through your Account settings.

CONFIDNETIALITY AND SECURITY

8.1 We follow generally accepted industry standards to ensure the security of your Personal Information on our systems. Also, User Personal Information is contained behind secured networks and is only accessible by a limited number of employees who have special access rights to such systems. However, there can inevitably be no guarantee of absolute security such as but not limited to when unauthorised disclosure arises from malicious and sophisticated hacking by malcontents through no fault of ours. Third parties may unlawfully intercept or access Personal Information transmitted to or contained on the Site, technologies may malfunction or fail to perform as anticipated, or someone might access, abuse or misuse information through no fault of ours. We will nevertheless deploy reasonable security arrangements to protect your Personal Information as required by the Privacy Laws.

THE "STAY SIGNED IN" OPTION

9.1 With your permission, we may use secure cookies to collect information about the devices you use to access the Site, which may include hardware model, operating system and version, IP address, and other unique device identifiers, mobile network information, and information about the device’s interaction with our Service. We also collect information about how you use our Service, including your access times, browser types, and language.
9.2 This data is used to remember your sign in information and reduce how often you have to enter your password on the same browser. By using this option, you agree that: (i) you are accessing the Site with a personal/trusted device, and (ii) the automatic Sign Out feature will be disabled. These cookies stay on your browser even after you close the Site and lasts for 90 days.
9.3 This option is safe to use on computers and devices that you can trust to protect your browser and shouldn’t be used on computers and devices that don’t protect your browser, such as public or shared computers, and computers you do not sign in to and cannot lock to protect your browser. You may clear this option by signing out from all devices in your Profile Settings.
9.4 You may manage how your browser handles cookies by adjusting its privacy and security settings. Browsers are different, so refer to instructions related to your browser to learn about cookie-related and other privacy and security settings that may be available.

THIRD PARTY WEBSITES

10.1 Third party websites that may be accessible through links from our Services are not controlled by us and, therefore, are not subject to this Privacy Policy. We recommend that you familiarize yourself with the privacy policies of each such websites prior to providing them with information.

AGE RESTRICTIONS

11.1 The Services are not intended for individuals under the age of 18. We do not knowingly collect Personal Information or non-personally-identifiable information from anyone under the age of 18, and no part of the Site or other Services are directed to anyone under the age of 18. If you become aware that your child has provided us with Personal Information, please contact us. If we become aware that an individual under 18 has opened an account and provided us with Personal Information, we take steps to remove such information and terminate that person's account.
